Throughout the past century, human intellectual capacity has seen a meteoric rise. Technological advancements like artificial intelligence (AI), blockchain, and cryptocurrency have revolutionised human capabilities, productivity, and with it, her potential achievements as a race. Just a decade ago, these concepts belonged firmly to the field of science fiction, reminiscent of shows like Star Trek or Knight Rider. This rise compelled me to consider how we may harness these innovations responsibly, equitably, and thoughtfully — with a suitable level of oversight.
Impact of AI Innovation
With the advent of OpenAI's groundbreaking product - ChatGPT - in the latter half of 2022, AI-as-a-service has become increasingly prevalent and recognized. However, many may not realise it, but AI’s reach was already present if not pervasive, extending into many facets of our lives. From the algorithms that curated our social media feeds and google searches, to the mobile navigation apps on our phones that show us how to navigate to our destinations and avoid traffic, AI was already shaping the way we interact with the world. Beyond mobile apps and social media feeds, ChatGPT and its various competitors in the AI-as-a-Service race, all hold transformative potential across diverse sectors, promising substantial benefits to humanity. Here are a few use cases already at play;

Risks with AI
These are some mouth watering benefits - and that’s just the tip of the iceberg. However this technology also has its own risks. Unregulated AI could lead to a myriad of issues, including
Data Privacy concerns owing to AI's reliance on vast amounts of personal data that raises concerns about privacy breaches, identity theft, and discriminatory practices. One significant concern lies in the potential for AI to attain such advanced cognitive abilities that it not only surpasses human intelligence but leads to a fall in human cognitive sharpness and even exert control over human decision-making processes. This scenario could cause unforeseen consequences that pose a grave risk to the entirety of humanity.
Economic disruptions could displace millions of jobs, exacerbate inequality, and trigger social unrest. A 2020 report by the World Economic Forum predicted that by 2025, automation will displace 85 million jobs globally. While AI is expected to create 97 million new jobs in the same timeframe, these roles will require different skills and training. This impending shift necessitates a significant overhaul of our education and training systems to ensure that workers are equipped to thrive in an AI-driven economy. Is the world ready for this?
The potential weaponization of AI poses a serious threat - whether it's deployed directly in physical combat or used to undermine civil liberties. These pressing challenges demand immediate attention and effective oversight measures to mitigate their real and present risks.
As we navigate the complexities of AI’s rapid advancement, critical questions demand our attention. How can we ensure that AI is leveraged for the greater good and not to our detriment? AI’s insatiable appetite for data brings significant privacy concerns to the forefront. The digital footprints we leave behind—social media posts, emails, website visits—are invaluable assets for AI companies, particularly in developing Large Language Models (LLMs). These extensive datasets enable AI models to recognize patterns, make predictions, and generate content. However, the collection and utilisation of personal data raise profound ethical questions.
The European Union is at the forefront of addressing these challenges through comprehensive regulatory measures. The General Data Protection Regulation (GDPR), for instance, sets strict guidelines on data collection, usage, and consent, ensuring individuals have greater control over their personal information. Additionally, the proposed EU AI Act aims to establish a legal framework that prioritises safety and fundamental rights by enforcing stringent requirements on high-risk AI applications. These proactive steps demonstrate the EU’s commitment to protecting privacy while fostering responsible AI innovation. In this context, the European Union (EU) assumes a leading role in opposing the influence of prominent technology corporations. In May, Meta temporarily halted the implementation of its artificial intelligence (AI) system within the EU due to concerns raised by the EU and the stringent regulatory framework within which it operates.
Events such as the Cambridge Analytica scandal in 2018, where Meta paid $725m to settle a class action suit, have underscored the potential for misuse of personal data by AI companies. In this case, data harvested from millions of Facebook users was exploited to target voters with political advertising, raising serious concerns about manipulation and the erosion of democratic processes’ integrity. This incident ignited a global debate, emphasising the urgent need for stronger data protection regulations and greater transparency in how AI companies collect and use personal information.
The AI Race - A Double-Edged Sword
The race to develop and deploy AI is intensifying, fueled by billions of dollars in investment and a global competition for technological dominance. OpenAI, for example, has received over $10+ billion in funding, while Anthropic has secured $7 billion. These companies are at the forefront of AI research, developing cutting-edge models like GPT-4 and Claude.
However, regulation is struggling to keep pace with the breakneck speed of AI development. With enormous resources, AI companies are making rapid advancements in AI technology and naturally often outstripping the slower and sometimes underfunded legislative processes, leading to significant gaps in oversight. Regulatory bodies face challenges such as a lack of technical expertise, insufficient resources, the complexity of AI systems, and fragmented government bureaucracies which make it difficult to create comprehensive and effective regulations. This lag allows potential risks to escalate unchecked, including the possibility of malicious actors gaining control of Artificial General Intelligence (AGI). The potential misuse of AGI for autonomous weapons systems, mass surveillance, and the manipulation of public opinion are just a few of the dystopian scenarios that have been envisioned. The urgency of addressing these risks is underscored by the fact that the development of AGI is not a matter of “if” but “when.” Without swift and effective regulatory measures, we risk allowing these technologies to outpace our ability to manage them responsibly.
Intersection of Economics, Culture, Leadership, and Feasibility
The trajectory of AI is not solely determined by technological advancements; it is also shaped by economic, cultural, and leadership factors. They will also affect how we effectively regulate it. From an Economic perspective, the US's capitalist model, with its emphasis on innovation and profit, can both propel and hinder the development of AI. While the free market can drive rapid progress, it can also lead to a prioritisation of commercial interests over ethical considerations.
The corporate culture of AI companies also plays a significant role. The values and beliefs of the individuals developing AI will inevitably influence the design and deployment of these technologies. The case of Sam Altman, the CEO of OpenAI, is a prime example. In 2023, Altman was briefly ousted from his position due to disagreements the board had with Sam over the way the company was being run. This incident highlighted the tensions that can arise between the desire for rapid growth and the need for responsible AI development. Altman was later reinstated, but the signal was clear - all was not well at OpenAI. At the time, I wondered what this type of power struggle meant for AI safety.
Moreover, the feasibility of AI products and services is a key factor that will affect the type of regulation that will be used. As AI technologies become more sophisticated and integrated into our lives, the need for robust governance mechanisms will only grow. Currently there are distractions in the form of political elections and the divisions of civil liberties and opinions. All of these will pale into insignificance once AI’s true impact starts being felt as it grows in mainstream popularity with young people, impacts jobs and changes how people live, and interact with each other and civil authorities. Before these happen, it is essential to commence conversations about how we implement effective oversight on AI and its impact.
The Quest for an Optimal Regulatory Model
The true potential of AI lies in its ability to surpass human intelligence, a prospect that both excites and terrifies. With the race towards Artificial General Intelligence (whatever your definition) accelerating, with billions of dollars invested in research and development, there needs to be a corresponding cohesive rise in effective regulation from its development to its deployment and use, to ensure safe, ethical and responsible user journey. It is important to set up a set of rules for AI and the companies behind AI that are both strong and forward-thinking to protect people, and support innovation.
There is no one-size-fits-all solution to the AI regulatory challenge. The rapid pace of technological advancement necessitates a dynamic and adaptable regulatory framework, capable of balancing the need for innovation with the imperative for safety, ethics, and accountability. Different models have been proposed, each with its strengths and weaknesses.
Self-regulation: This model relies on AI companies to police themselves, setting internal standards for safety, ethics, and transparency. OpenAI, the company behind ChatGPT, announced a new Safety and Security Committee (after disbanding its AI Superalignment team) shortly after the civil war where Altman was fired and reappointed. This self-regulatory effort reflects the company's recognition of the potential risks associated with AI. Such approaches can enable rapid adaptation to technological changes and promote innovation. However, a major critique of self-regulation is its susceptibility to conflicts of interest and lack of robust enforcement mechanisms, potentially resulting in inadequate safeguards against misuse or ethical breaches. For example, despite self-regulatory efforts in the financial sector, some AI applications have perpetuated or even amplified existing biases in credit scoring systems, leading to discriminatory outcomes and raising serious ethical concerns.
Government regulation: This model involves the government creating laws and regulations to govern the development and use of AI. Government oversight, with its power to enforce and its broader societal perspective, can provide a more comprehensive and enforceable framework. The European Union's proposed AI Act, for example, aims to create a legal framework that prioritises safety and fundamental rights by establishing clear rules and obligations for AI systems. It proposes stringent requirements for high-risk AI applications, such as those used in critical infrastructure or law enforcement, potentially preventing harmful outcomes. However, critics argue that government regulation can be slow-moving and risk stifling innovation. The AI Act's broad definitions and stringent requirements have been criticised for potentially hindering AI development in Europe by creating excessive compliance burdens for businesses, particularly smaller startups. This could slow the pace of innovation and create barriers to entry for new players in the AI market.
Peer regulation: This model emphasises collaboration among AI companies to establish industry-wide standards and best practices. This cooperative approach can foster shared responsibility and accountability, as companies work together to address common challenges and develop ethical guidelines. The Partnership on AI, a multi-stakeholder organisation that includes major tech companies like Google and Microsoft, exemplifies this approach by promoting responsible AI development and deployment. There are also a number of academic-led initiatives created to help foster transparency and positive impact of AI. Stanford University’s Centre for Research of Foundational Models and its AI Index Report both provide independent insights into how the various LLMs are being developed and how they are impacting society. Both initiatives are driven by leading minds, policy makers and entrepreneurs in AI. While this does not translate to oversight, it does improve responsible and innovative development of this emerging technology. That said, it is acknowledged that achieving consensus on complex issues can be challenging, and without a formal enforcement mechanism, compliance may be inconsistent, especially given the competitive and in some cases, closed nature of developing the models by various AI companies.
A Hybrid Approach: Each regulatory model offers distinct advantages and poses unique challenges. A hybrid approach, combining elements of self-regulation, government oversight, and peer collaboration, might offer the most balanced and effective solution. This approach could leverage the agility and expertise of industry self-regulation, the authority and broader societal perspective of government oversight, and the collaborative problem-solving potential of peer regulation. By integrating these different approaches, a hybrid model could promote innovation while ensuring safety, ethics, and accountability in the development and use of AI.
In practice, each model has been implemented to varying degrees around the world. In April, the US Department of Homeland Security announced the establishment of the Artificial Intelligence Safety and Security Board. With leading for-profit figures in the industry such as Nvidia’s Jensen Huang, Sam Altman, and Google’s Sundar Pichai, though there are concerns not-for-profit leaders are underrepresented. This reflects an increasing trend for greater oversight over AI companies in the laissez faire US. The European Union, with its emphasis on data protection and algorithmic transparency through initiatives like the EU AI Act has taken a proactive stance on AI regulation. This contrasts with the United States, which has largely relied on self-regulation by AI companies, allowing for rapid innovation but raising concerns about accountability and ethical standards. Meanwhile, peer regulatory bodies, akin to the Financial Industry Regulatory Authority (FINRA) in the US banking sector, demonstrate how industry-wide cooperation can enforce standards effectively. By drawing on the strengths of these diverse regulatory models, a hybrid approach can foster an environment where AI innovation thrives while addressing the critical concerns of safety, ethics, and accountability. This balanced approach is essential for harnessing AI's transformative potential for the benefit of society.
Too Important to Ignore
The power of AI is undeniable, its potential transformative, yet its risks are equally profound. As we stand on the precipice of a new era defined by artificial intelligence, the question is not if we should regulate AI, but how. We must embrace a regulatory approach that is as dynamic and adaptable as the technology itself.
